Il sentimento di (s)fiducia dei cittadini verso i magistrati.
Nell’età della diffidenza, quale fiducia nella magistratura?
Siamo in un’epoca di diffidenza generalizzata, dalla quale nessuna persona e nessuna istituzione sembra potersi sottrarre. Non più la diffidenza o il sospetto come atteggiamenti propri dei soli intellettuali, riferiti a quelli che, sulla scia di Paul Ricoeur, sono stati chiamati “maestri del sospetto”; e neanche la diffidenza intesa come patologia riguardante poche persone, inquadrabile come disturbo della personalità. No, ciò di cui parlo, e che constatiamo agevolmente anche nei nostri comportamenti quotidiani, sono la diffidenza nei rapporti interpersonali e il suo omologo nei rapporti sociali, cioè la sfiducia verso le “autorità” e verso le istituzioni rappresentative, a qualunque livello e in ogni settore, pubblico e privato.
Quando la diffidenza viene a toccare in misura sensibile la magistratura, ci troviamo ai limiti estremi di tenuta della convivenza civile e quindi deve scattare subito un campanello d’allarme.
Scrivo queste cose anche influenzato dalla lettura della sintesi di un’interessante ricerca (promossa dalla Scuola superiore della magistratura e curata da due esperti quali N. Delai e S. Rolando) sul tema “Magistrati e cittadini”, dalla quale emerge la conferma di una progressiva erosione della fiducia verso la giustizia in generale e i magistrati in particolare, dovuta a diverse concause, che attengono ai tempi troppe volte infiniti dei processi, ai rapporti tra magistratura e politica (o leader politici), al modo con cui il sistema dell’informazione tratta il mondo giudiziario.
Scrivo queste cose anche influenzato dalla lettura della sintesi di un’interessante ricerca (promossa dalla Scuola superiore della magistratura e curata da due esperti quali N. Delai e S. Rolando) sul tema “Magistrati e cittadini”, dalla quale emerge la conferma di una progressiva erosione della fiducia verso la giustizia in generale e i magistrati in particolare, dovuta a diverse concause, che attengono ai tempi troppe volte infiniti dei processi, ai rapporti tra magistratura e politica (o leader politici), al modo con cui il sistema dell’informazione tratta il mondo giudiziario.
Dalla ricerca emerge che la “cura” per l’ammalata giustizia potrebbe stare anzitutto nella capacità di ciascuno – magistrato, operatore giudiziario, politico, giornalista, professionista del foro, cittadino comunque coinvolto in procedure giudiziarie – di riappropriarsi in modo virtuoso del proprio ruolo, recuperando una corretta fiducia negli altri operatori e facendo la propria parte sino in fondo, tenendo sempre ben presenti la condizione e i problemi degli altri soggetti che si muovono nel pianeta giustizia.
L’orientamento del Csm, in questi primi quindici mesi di nuova consiliatura, da un lato di intervenire senza esitazioni sulle storture e sulle magagne, anche relative a singoli magistrati e, dall’altro lato, di sostenere ed incoraggiare in ogni modo la parte buona, cioè la quasi totalità della magistratura, sembra il più idoneo a sostenere la battaglia per una rinnovata fiducia dentro e verso il pianeta giustizia.
