L’articolo 314 del c.p.p. (Codice di Procedura Penale) prevede un risarcimento per ingiusta custodia cautelare. Di cosa si tratta esattamente? Scopri i dettagli nel nostro glossario giuridico!
Molto spesso si sente parlare di persone che sono state private della loro libertà personale poiché si sospetta che abbiano commesso un reato.
Queste rimangono in prigione durante le indagini preliminari, fino a quando il giudice emette una sentenza riguardo alla loro colpevolezza o innocenza.
A questo proposito, l’art. 314 cpp prevede un risarcimento in caso di ingiusta custodia cautelare.
Art. 314 cpp: Di Cosa Si Tratta
L’art. 314 cpp prevede un’equa riparazione, ovvero una quantità di denaro, per quelle persone che sono state sottoposte ingiustamente a custodia cautelare, detta anche custodia preventiva o carcerazione preventiva.
La custodia cautelare comprende, oltre alla custodia in carcere, la custodia in luogo di cura e gli arresti domiciliari.
A Chi Si Rivolge
Si considera vittima di custodia cautelare ingiusta:
- Chi è stato assolto, con sentenza definitiva, poiché il fatto non sussiste, poiché il fatto non costituisce reato o non è previsto dalla legge come reato, per non aver commesso il fatto.
- Chi è stato assolto in seguito a una sentenza di non luogo a procedere o in seguito ad un provvedimento di archiviazione.
In questi due casi si parla di ingiustizia sostanziale.
- Chi, indipendentemente se dichiarato colpevole o innocente, è stato sottoposto a carcerazione preventiva nonostante non ci fossero le condizioni necessarie per farlo (in tal senso, si vedano gli articoli 273 e 280).
In quest’ultimo caso si parla di ingiustizia formale.
E’ bene ricordare che l’art. 314 cpp si riferisce solo ed esclusivamente ai casi sopra illustrati; nel caso di un’ingiusta carcerazione derivante da un errore giudiziario si applica, invece, l’art. 643 cpp.
Come Procedere
La richiesta di risarcimento deve essere presentata alla Corte d’Appello entro due anni da quando:
- La sentenza di assoluzione o condanna diventa definitiva.
- La sentenza di non luogo a procedere diventa inoppugnabile.
- Il provvedimento di archiviazione viene notificato.
Il risarcimento richiesto non può superare il valore di 516.456,90 euro.
