Cosa Succede Quando un Giornale Usa la Tua Foto Per un Articolo su un Tuo Omonimo Condannato

Nicola Russo, giudice della Corte di Appello di Napoli, è stato vittima di uno scambio di persona con un altro magistrato. La sua foto è stata utilizza per errore per la condanna di un ex giudice. Leggi ora per scoprire la sua vicenda!

Lunedì Il Fatto Quotidiano ha raccontato la bizzarra vicenda di un giudice, Nicola Russo, la cui foto nei mesi scorsi è stata usata da giornali e siti Internet in articoli che riguardavano le vicende giudiziarie di un altro giudice, suo omonimo, condannato per corruzione e prostituzione minorile.

Il Nicola Russo che Il Fatto Quotidiano ha intervistato è giudice della Corte di Appello di Napoli, mentre il suo omonimo è un ex giudice del Consiglio di Stato.

Quest’ultimo nel settembre del 2020 era stato condannato a 11 anni di carcere con l’accusa di corruzione in atti giudiziari.

La condanna era arrivata in seguito a un’indagine partita dalle dichiarazioni di un avvocato, secondo cui il giudice aveva ottenuto da lui circa 80mila euro (che gliene avrebbe promessi altri 60mila), per emettere sentenze a favore di due suoi assistiti in tre procedimenti davanti al Consiglio di Stato.

Russo era già stato sospeso in precedenza, in seguito a una condanna in primo grado per prostituzione minorile.

Nei giorni della sentenza di settembre molti giornali, compreso Il Fatto Quotidiano, avevano pubblicato articoli utilizzando come foto quella del Nicola Russo giudice della Corte di Appello di Napoli.

Sulle agenzie di stampa c’è infatti una sola foto di un giudice di nome Nicola Russo, quello incensurato, e i giornali hanno utilizzato quella senza controllare se si trattasse del giudice giusto.

La foto era stata realizzata mentre Nicola Russo era in udienza durante il processo che portò alla condanna in primo grado di Silvio Berlusconi per la compravendita dei senatori (condanna in seguito prescritta).

Russo ha raccontato al Fatto Quotidiano di non aver mai conosciuto il Nicola Russo condannato e di non sapere chi sia, e di come questo errore da parte dei giornali gli abbia causato diversi problemi anche sul lavoro.

Giudice Russo, dopo aver visto otto volte la sua foto a corredo di notizie su indagini e condanne, si sarà convinto anche lei di essere un corrotto.

(Ride). Per fortuna no, decisamente no. Sono ancora certo di essere un giudice e una persona per bene. Il problema è che possa essersene convinto qualcun altro.

Russo ha raccontato, per esempio, di quando il direttore dell’accademia giudiziaria della Repubblica Ceca gli scrisse in una lettera che non avrebbe potuto confermare la sua presenza come relatore ad un convegno sulla corruzione nel caso fosse stato lui il giudice condannato per prostituzione minorile.

Secondo Russo questo errore riguarda non solo lui, ma tutta l’Italia, che rappresenta in quanto giudice:

Da quel momento mi preoccupo, sempre, quando sono invitato ad eventi pubblici, di compiere questa precisazione, e ciò mi costa davvero tanto dal punto di vista psicologico ed anche per l’amore che ho per la magistratura, dovendo dare ulteriore eco a fatti che offendono e feriscono la funzione giudiziaria.

I problemi riguardano anche la presenza della sua foto nelle ricerche su Google, che continua a essere associata al giudice condannato.

Russo ha detto di essersi rivolto al Garante della privacy per risolvere questo problema, che però fino ad oggi non lo ha «minimamente preso in considerazione».

Nell’intervista Russo ha anche parlato di come sia possibile che tanti giornali abbiano commesso questo grave errore, e di cosa dovrebbe fare il settore dell’informazione per evitare che episodi del genere si ripetano, specificando che «in ogni caso è doveroso non pubblicare alcuna foto se non si è sicuri dell’identità della persona ritratta»:

L’informazione non dovrebbe rincorrere l’immediatezza, lo scoop ad ogni costo, ma trovare il tempo di fare i giusti e dovuti approfondimenti. Dovrebbe rallentare. Ragionare. Valutare. Tornare all’origine del suo scopo. Oggi più che mai le persone hanno bisogno di essere guidate nella riflessione, nel discernimento visto l’enorme ed ingestibile quantità di notizie da cui vengono raggiunte.
