Quando il passare del tempo fa perdere un diritto perché la persona titolare non lo ha esercitato si parla di prescrizione.

Che Cos’è?

La prescrizione è un istituto giuridico (cioè un insieme di norme che regolano uno stesso argomento) che riguarda gli effetti del trascorrere del tempo su un certo procedimento.

In altre parole: se non esercito un mio diritto nel periodo che la legge stabilisce, io perdo quel diritto che, quindi, cade in prescrizione.

I diritti si prescrivono per offrire ai cittadini garanzie di certezza, punendo chi non esercita il proprio diritto nei tempi indicati dalla legge, a vantaggio di un’altra persona. Ad esempio, questo succede quando si prescrive un credito e il debitore si libera dall’obbligo di pagare.

I Requisiti

  • L’esistenza di un diritto
  • Il mancato esercizio di questo diritto da parte di chi ne gode
  • Il superamento dei limiti di tempo determinati dalla legge

Tipologie di Prescrizione

  • Ordinaria: dura dieci anni in tutti i casi in cui la legge non prevede una durata diversa
  • Breve: ha una durata minore di dieci anni, ad esempio in cinque anni si prescrive il diritto al risarcimento del danno
  • Presuntiva: in determinati casi, il decorso di un certo periodo di tempo fa nascere a favore del debitore una presunzione legale che il pagamento sia avvenuto.

La prescrizione presuntiva ha un termine molto più breve della prescrizione ordinaria, o di tre anni o di un anno. La legge presume che il credito sia stato già pagato.

Abbiamo detto «presume»: questo significa che – a differenza di quella ordinaria – è sempre ammessa la prova contraria.

Si tratta di ipotesi relative a fatti della vita quotidiana, quando i rapporti non sono troppo formali e non sempre vengono rilasciati documenti che provano il pagamento, ad esempio il credito dei farmacisti per il pagamento dei medicinali o degli albergatori per un soggiorno.

Quando Inizia?

La precrizione inizia dal momento in cui una persona può esercitare il suo diritto, anche se non lo esercita o anche se la persona non sa dell’esistenza del diritto in questione. Diverso è se questa ignoranza è colpa del comportamento scorretto e intenzionale di un altro soggetto.

Sospensione e Interruzione

Sospensione e interruzione della prescrizione sono due concetti diversi.

Il corso della prescrizione può essere sospeso quando il mancato esercizio del diritto da parte del titolare c’è, ma è giustificato dalla legge per determinate cause. Fino a quando la causa che per legge determina la sospensione della prescrizione rimane, il corso di questa è sospesa.

A differenza della sospensione, con l’interruzione non si apre una semplice parentesi nel periodo di prescrizione, ma, “muore” il periodo già trascorso e comincia un nuovo periodo pari a quello iniziale.

Si ha l’interruzione della prescrizione quando il titolare del diritto mostra la sua volontà di esercitarlo. Da questo momento appunto, si calcola un nuovo periodo di prescrizione, senza considerare quello già trascorso.

Esempio: Lucia deve pagare Giacomo. Giacomo invia a Lucia una richiesta scritta di pagamento dopo 5 anni; è in questo momento che per Lucia ricomincia da zero il termine di prescrizione.

La Riforma

L’1 gennaio 2020 è entrata in vigore la riforma sulla prescrizione. La novità più importante è che i suoi termini vengono interrotti dopo la sentenza di primo grado, sia in caso di condanna che di assoluzione.
