Risposta Del Senatore Luigi Gaetti, Al Questionario Sulla Giustizia

Il Senatore Luigi Gaetti risponde al questionario sulla giustizia inviato dall’Associazione Italiana Vittime di malagiustizia.

Egregio Presidente AIVM

Ho letto le domande che lei pone nel questionario, alcune mi sembrano tendenziose.

Sono un anatomo patologo e ho fatto molte autopsie come consulente tecnico d’ufficio per l’Autorità Giudiziaria per cui mi sono fatto un’idea. Ho visto centinaia di denunce ai medici che poi si sono risolte in nulla. Tengo a precisare che non ho mai fatto consulenze di parte.

Credo che qualche pm o giudice sbagli, diversi sono stati processati, ricordo alcuni casi clamorosi.

Il libro di Genchi ne evidenzia molti altri. Ma dire che la giustizia non va, non serve a nessuno se non ai privilegiati (ed io potrei essere tra questi).

Credo che vadano cambiate le leggi, basta togliere la prescrizione ed i processi sarebbero più rapidi, in quanto gli avvocati non hanno interesse ad allungarli.

Come medico posso parlare dei tecnicismi sanitari, non ho la competenza per parlare di tecnicismi giudiziari, comunque leggendo noto che cose molte semplici come sistemare le notifiche determinerebbe un grande risparmio.

Ritengo comunque che il potere giudiziario debba essere indipendente e far pagare chi sbaglia.

Non conosco l’operato dell’AIVM, ma da medico e soprattutto da patologo ogni caso è unico e generalizzare è un errore macroscopico.

Poi analizzando il caso mafia stato dove ben 6 persone sono state condannate all’ergastolo per la strage di Borsellino in ben tre gradi di giudizio, chi è il colpevole?

Poi appare chiaro che un giudice deve dare ragione ad uno e torto ad un altro, per cui è facile dire che chi ha subito torto è vittima di un errore.
