Quanto costano gli errori di malagiustizia al nostro Paese? Questo articolo del Quotidiano di Sicilia ci aiuta a fare il punto della situazione.

Secondo una recente indagine promossa da Confindustria e sostanzialmente confermata dall’Ufficio studi della Banca d’Italia, la “malagiustizia” costa al nostro Paese circa il 4,9% del PIL, vale a dire tra i 15 e i 18 miliardi di euro l’anno.
Si tratta di una somma straordinariamente alta, soprattutto se vi si sommano, ad esempio, i circa 3 miliardi iscritti nel bilancio dello Stato alla voce carceri!
Se poi a queste cifre si affiancano quelle riguardanti il numero totale di reclusi, circa 59.000, la percentuale di essi che sono ancora in attesa di giudizio, dunque formalmente innocenti, circa il 42%, e i tempi di durata dei processi che, in alcuni casi, superano persino i 20 anni, ci rendiamo subito conto che l’autoreferenzialità e lo sfascio del sistema giudiziario sono del tutto incompatibili con un Paese civile!
Al di là degli aspetti meramente legali, al di là delle ripetute sanzioni che l’Italia è costretta a pagare a causa delle lungaggini della sua giustizia, delle penose e poco dignitose condizioni del sistema carcerario e dell’incertezza che questo stato di cose determina nella vita del Paese, quale investitore straniero si sognerebbe mai di spendere un solo centesimo per aprire un’azienda dalle nostre parti?
L’incertezza del sistema giudiziario italiano, unito all’intangibilità dei suoi esponenti, unica casta ormai rimasta in piedi, ha trasformato l’Italia, un tempo patria del diritto, nella terra in cui, ormai, nulla è certo: nessun diritto può essere considerato realmente tale e nessuno, tranne i magistrati, in quanto giudici di se stessi, può considerarsi sicuro della legalità dei propri comportamenti.
Ma se ciò non bastasse, nella piena consapevolezza della vulnerabilità del vigente modello giudiziario e dei suoi costi esorbitanti, si abbassa sempre di più la stima dei cittadini nei confronti di questa istituzione, dunque dello Stato.
Come si fa a considerarsi soddisfatti di una magistratura che paralizza tra i 4 e i 5 milioni di procedimenti impiegando anni, anzi decenni per la loro definizione?
Come si fa a stimare una magistratura che esprime uomini che saltellano da un talk show all’altro, da un convegno all’altro, da una consulenza all’altra, da una commissione di collaudo all’altra piuttosto che studiare i casi a loro assegnati?
Nulla accade per caso!
