Nel 1993 tre giovani ragazzi dell’Arkansas vennero accusati di aver torturato e ucciso tre bambini: in seguito saranno condannati nonostante la totale mancanza di prove.
Nel 1993 una tranquilla cittadina americana è scossa dalla terribile morte di tre bambini, in una caso che diventerà noto come l’omicidio di West Memphis.
Le autorità sospettano che gli omicidi siano parte di un perverso rito satanico e arrestano tre adolescenti condannandoli all’ergastolo. Ma erano davvero loro i colpevoli?
Il Delitto
Nel nostro paese in pochi conoscono i nomi di Damien Echols, Jessie Misskelley Jr e Jason Baldwin ma insieme hanno formato il “trio di West Memphis”, protagonista di una delle più grandi storie di malagiustizia degli Stati Uniti.
Tutto iniziò il 5 maggio del 1993, quando Christopher Byers, Stevie Branch e Micheal Moore, tutti di otto anni, uscirono da scuola ed andarono nei boschi intorno alla città.
Non tornarono mai più a casa. La famiglia di Byers, non vedendolo rientrare quella sera denunciò la scomparsa alla polizia, che avviò immediatamente le ricerche.
La polizia trovò i corpi senza vita il giorno seguente all’interno di un torrente: tutti e tre avevano mani e piedi legati e mostravano i segni di un violento pestaggio.
Byers inoltre riportava diverse ferite giudicate compatibili con l’accoltellamento e numerose mutilazioni.
La polizia di West Memphis rimase spiazzata: nessuno aveva mai lavorato ad un caso di omicidio simile; lasciarono infatti incustodita la scena del crimine per giorni, compromettendo così tutti gli indizi.
Le Indagini
Lo stato dei cadaveri portò la polizia a pensare che l’omicidio facesse parte di un rituale satanico, cosa che portò un funzionario dei minori a fare il nome di Damien Echols, adolescente che viveva a West Memphis.
Echols aveva alle spalle una lunga storia di problemi psichiatrici, amava la musica heavy metal e aveva cominciato ad approfondire la magia e l’occultismo.
Per la polizia di una piccola città dell’Arkansas questo lo rendeva un pericolo satanista, in grado di uccidere dei bambini in un macabro rito pagano.
Le indagini, viziate dal pregiudizio verso Echols, furono a senso unico: nonostante i due interrogatori però la polizia non riuscì a ottenere una confessione.
Nel frattempo una ragazza confidò agli investigatori che Echols aveva ammesso di aver partecipato a dei rituali satanici insieme all’amico Miskelley.
Un altra persona dichiarò che Echols aveva addirittura confessato l’omicidio mentre si trovava in stato di ebrezza.
Queste dichiarazioni però erano piene di inesattezze e di particolari che non corrispondevano alla realtà.
I due adolescenti infatti ritrattarono immediatamente e ammisero di aver inventato tutto sperando di intascare una ricompensa.
Nonostante questo gli investigatori continuarono a usare queste dichiarazioni come prova e decisero di concentrarsi sull’anello debole del gruppo, Jessie Miskelly jr.
Il ragazzo, che aveva un QI di poco superiore alla soglia del ritardo mentale, dovette sopportare 12 ore di interrogatorio senza un legale e sottoposto a continue minacce.
Stremato dalle numerose ore di interrogatorio, Miskelly fornì una confessione vaga e piena di errori, che ritrattò più volte nello stesso interrogatorio.
In particolare cambiò l’ora dell’omicidio più volte e dichiarò di aver picchiato e soffocato i ragazzi con un bastone, particolari che non concordavano con l’autopsia.
Chiamò in causa anche l’amico Jason Baldwin, che aveva partecipato all’omicidio sfregiando Byers con un coltello.
Un’altra autopsia però rivelò che le ferite sul corpo del bambino erano compatibili con i morsi di tartarughe che vivevano nel torrente.
Condanna e Scarcerazione
Nonostante l’assenza di prove i tre ragazzi ottennero un verdetto di colpevolezza: Baldwin e Miskelley, minorenni,furono condannati all’ergastolo mentre Echols, maggiorenne, venne condannato a morte.
La vicenda infiammò l’opinione pubblica: in molti si interessarono alla vicenda e compresero che i tre avevano avuto un processo iniquo, condizionato da dichiarazioni estorte.
Il numero di sostenitori dell’innocenza dei tre di West Memphis aumentò ancora di più quando l’emittente televisiva HBO realizzò due documentari in cui metteva in mostre le tantissime lacune nelle indagini.
A quel punto sempre più persone chiesero una revisione del processo, tra cui personaggi famosi come Peter Jackson, Eddie Vader e Johnny Depp.
Nel 2010 perciò lo stato riaprì il caso e la difesa dimostrò che il DNA sulla scena del crimine non era compatibile con gli imputati.
Grazie alle analisi del DNA l’anno successivo la corte dell’Arkansas prosciolse dalle accuse i tre ragazzi, ormai diventati uomini, e ne ordinò la scarcerazione dopo diciotto anni di ingiusta detenzione.
Una triste vicenda di malagiustizia che purtroppo si è ripetuta più volte negli Stati Uniti.
Ad oggi il caso rimane aperto e l’assassino dei tre bambini rimane a piede libero.
