Il Caso Di Calogero Ponticello

Il caso di Calogero Ponticello, ottantunenne siciliano, ex impiegato comunale, citato in giudizio per inadempimento.

Il caso

La vicenda di Calogero Ponticello: ottantunenne di origine siciliana (provincia di Agrigento), ex-impiegato comunale, è l’ennesima vittima della cronica lentezza del sistema processuale italiano.

Tutto ebbe inizio nel 1979 con la stipula di un contratto preliminare di compravendita, avente ad oggetto un modesto appezzamento di terreno (del valore di 45,000,000 delle vecchie lire), che Ponticello avrebbe destinato all’avviamento di un’attività commerciale a favore dei tre figli.

Al momento del rogito, riscontrando la non conformità del frazionamento rispetto al regolamento edilizio, Ponticello rifiuta la sottoscrizione del contratto definitivo e ne chiede la regolarizzazione. I promettenti venditori citano in giudizio Ponticello per inadempimento.

Inizia così, nell’Ottobre del 1988 il caso ed il suo calvario giudiziario. Per la definizione del primo grado di giudizio bisognerà attendere 7 anni: il Tribunale di Agrigento emette infatti sentenza solo nell’Ottobre del 1995, senza peraltro accogliere le istanze di Ponticello. Nel Marzo del 1996 la vicenda prosegue innanzi alla Corte d’Appello di Palermo. Anche in questo caso la definizione del procedimento non arriverà in tempi brevi, bensì dopo 11 anni. Tuttavia, in un primo momento, l’ attesa sembra ripagare positivamente le aspettative di Ponticello: in quanto il consulente d’ ufficio rileva la non conformità del frazionamento.

Ma inaspettatamente il processo si conclude nel Marzo del 2007 con un’ ordinanza di inammissibilità per un vizio di notifica relativo all’atto di integrazione del contraddittorio, peraltro risalente a 9 anni prima. Forte delle sue ragioni, suffragate da tecnici e legali, Ponticello ricorre, nel Marzo del 2008, alla Corte di Cassazione, riaprendo così il caso. Lamenta principalmente l’erronea valutazione del momento di perfezionamento della suddetta notifica da parte del giudice dell’ appello, il quale anziché considerare il momento di affidamento dell’ atto all’ufficiale giudiziario, prende in considerazione il momento in cui il destinatario ha ricevuto la notifica.

Proprio in tema di notificazione dell’atto di integrazione del contraddittorio, la giurisprudenza della Suprema Corte segue tale orientamento:

“La notifica di un atto processuale, almeno quando essa debba compiersi entro un determinato termine, si intende perfezionata, per il notificante, al momento dell’affidamento dell’atto all’ufficiale giudiziario che funge da tramite necessario nel relativo procedimento vincolato, senza quindi che possa influire negativamente per la parte il mancato perfezionamento della medesima notifica, ove non a lei imputabile.”  Corte di Cassazione, sentenza n. 371 del 9 Gennaio 2013.

L’esito

Ad oggi Ponticello è ancora in attesa della sentenza della Corte di Cassazione, dopo 6 anni dall’ instaurazione del procedimento. Dopo 26 anni di lotte giudiziarie, nell’ambito delle quali le sue pretese non hanno ancora trovato riscontro, l’unica inesorabile certezza per Ponticello, ormai da tempo affetto da ipertensione, è di aver subito una perdita patrimoniale, a fronte delle spese processuali, superiore al quadruplo del valore iniziale del terreno.

Alla domanda che opinione ha oggi della giustizia, Ponticello, a malincuore, risponde di aver perso fiducia nel sistema giudiziario italiano. Il susseguirsi di inefficienze, ritardi e negligenze (per le quali ancora oggi sta pagando le conseguenze) hanno progressivamente eroso quella fiducia che lo ha portato a non desistere fino al terzo grado di giudizio.

In casi come questi ci si può rivolgere all’AIVM – Associazione Italiana Vittime di Malagiustizia – che dal 2012 lotta al fianco di chiunque ne abbia bisogno e ritenga di aver ricevuto una sentenza ingiusta. L’associazione non ha scopo di lucro e chiunque si rivolga ad essa non deve nulla per il sostegno e l’assistenza ricevuti.
