Il Ministero della Giustizia, nella Relazione al Parlamento del 2020, ha rilevato che nel corso dell’anno sono stati introdotti 1.108 procedimenti volti a chiedere la riparazione per ingiusta detenzione, in base all’art. 314 del Codice di Procedura Penale. Sono state emesse 750 ordinanze di pagamento per un totale di circa 37 milioni.
Dei 1108 procedimenti introdotti, quelli accolti e non più impugnabili sono 283. In 203 casi l’indennizzo deriva da una sentenza di proscioglimento, mentre nei restanti 80 casi da illegittimità dell’ordinanza di custodia cautelare.
I provvedimenti che prevedono gli esborsi di maggiore entità riguardano l’area meridionale, nello specifico la Corte di appello di Reggio Calabria (7.907.009), di Catanzaro (4.584.530) e Palermo (4.399.761). Nell’area settentrionale gli indennizzi più consistenti provengono da provvedimenti emessi dalla Corte di appello di Milano (1.327.208).
La Relazione illustra anche i procedimenti disciplinari che hanno coinvolto i magistrati per le accertate ingiuste detenzioni. Le azioni promosse nell’ultimo triennio sono state 61: 12 assoluzioni, 4 censure e 17 non luogo a procedere. Sono tutt’ora in corso 25 procedimenti.
Dalla comparazione di questi dati, appare evidente come il riconoscimento del diritto alla riparazione per ingiusta detenzione non comporti automaticamente la responsabilità disciplinare a carico dei magistrati che abbiano richiesto, applicato e confermato il provvedimento restrittivo risultato ingiusto.
Di fatti, dopo la riforma degli illeciti disciplinari del 2006, la responsabilità disciplinare sussiste quando si abbia “l’emissione di un provvedimento restrittivo della libertà personale fuori dei casi consentiti dalla legge, determinata da negligenza grave e senza scusanti”.
Il Ministro Cartabia, nel corso della Relazione al Parlamento, ha affermato:
“sono state confermate le istruzioni già impartite ai Magistrati Ispettori tese ad ampliare lo spettro degli accertamenti in sede di verifica ispettiva ordinaria su tutte le ipotesi di ingiusta detenzione, integrando i controlli già previsti sulla applicazione e gestione delle misure custodiali e sull’indebita protrazione delle stesse in violazione dei termini di legge”.
Affermazione che sancisce l’interesse del Ministero della Giustizia sul tema dell’ingiusta detenzione.
