Palazzesi, Detenzione Ingiusta Lo Stato Ora Dovrà Risarcirlo

Campagnatico. Una settimana in carcere, un mese agli arresti domiciliari, poi l’obbligo di firma. Detenzione ingiusta: adesso deve essere risarcito, ha stabilito la Corte di appello di Firenze.

Massimiliano Palazzesi, oggi 53 anni, quell’estate del 2009, quando venne indagato per un’ipotesi di corruzione nell’ambito dell’inchiesta Amici Miei sui presunti illeciti al Comune di Campagnatico, non se la potrà mai scordare.

Quando venne ascoltato come testimone in Tribunale – ed era il 2011 – l’imprenditore a suo tempo responsabile della Perna Elio & c. costruzioni tirò fuori tutto quello che si era tenuto dentro, parole di fuoco contro chi aveva fatto l’indagine: «Sono disgustato, se lei mi avesse sentito prima di arrestarmi…» disse al pm Stefano Pizza.

Nel 2016, quando il magistrato che aveva ereditato il ponderoso fascicolo chiese l’archiviazione, fece di nuovo sentire la sua voce: «Io non voglio la prescrizione, io voglio essere giudicato nel merito».

Nel 2018 il riconoscimento della Cassazione: «L’archiviazione è stata illegittima», Palazzesi aveva diritto a uno sviluppo diverso del procedimento tale anche da propiziare il riconoscimento dell’indennizzo. Indennizzo adesso arrivato.

La Seconda sezione penale della Corte di appello di Firenze, presieduta da Maria Teresa Scinicariello, ha pronunciato un’ordinanza con cui ha riconosciuto che la detenzione subita dal 6 agosto 2009, era ingiusta, condannando lo Stato italiano a risarcirlo per la ingiustificata privazione di libertà.

Ne dà notizia l’avvocato Riccardo Lottini, che con i colleghi Camilla Toninelli e Luca Di Paola ha seguito questo secondo aspetto, mentre quelle precedenti erano state curate dagli avvocati Luciano Giorgi e Carlo Valle. Cifra non resa nota, ma comunque soddisfazione per il riconoscimento delle proprie ragioni.

All’epoca, la Procura ipotizzava che in cambio di lavori effettuati presso l’abitazione del sindaco di Campagnatico, l’imprenditore avesse ottenuto in via preferenziale affidamenti di lavori pubblici in violazione della normativa sugli appalti. Palazzesi fu incarcerato e gli fu vietato di parlare per cinque giorni con il proprio difensore.

«Rimase in isolamento – aggiunge Lottini – rinchiuso in una stanzetta di pochi metri quadrati, senza la possibilità di leggere un libro o un quotidiano per passare il tempo, e nemmeno di avere un contatto con il legale che in caso di carcerazione è spesso l’unico conforto per il detenuto».

Due giorni dopo l’interrogatorio di garanzia, l’imprenditore fu messo ai domiciliari, da cui uscì il 14 settembre per decisione del Tribunale della libertà.

Finalmente era arrivato il tempo del giudizio ma la sua posizione era stata stralciata rispetto a quella dell’allora sindaco Elismo Pesucci, coimputato e poi assolto su richiesta del pm Arianna Ciavattini (per l’ex sindaco nel 2019 la Corte di appello aveva respinto la richiesta di ingiusta detenzione): Palazzesi non era stato mai processato, per lui era stata chiesta l’archiviazione perché era passato troppo tempo, per prescrizione.

Si era rivolto alla Cassazione, poi la Procura aveva chiesto per lui una seconda richiesta di archiviazione, ma con la motivazione che «gli elementi non erano in grado di poter sostenere un’accusa in giudizio». Richiesta accolta dal gip.

Così era partita la procedura per la riparazione per ingiusta detenzione. Il 17 dicembre scorso l’udienza in Appello.

«La Procura generale aveva caldeggiato l’accoglimento dell’istanza, mentre l’Avvocatura di Stato, che rappresentava il Ministero dell’economia (che materialmente dovrà pagare il risarcimento) aveva chiesto il rigetto, evidenziando la negligenza in cui sarebbe incorso Palazzesi che, pur essendo titolare di affidamento di lavori pubblici, non si era astenuto dall’intrattenere rapporti economici con il vertice dell’Amministrazione comunale.

La Corte di Appello ha dato ragione a Palazzesi mettendo in evidenza l’assoluta correttezza del suo comportamento: a fronte dei lavori effettuati al sindaco, aveva emesso regolare fattura e contabilizzato in bilancio il credito.

Quindi il credito vantato nei confronti del sindaco risultava da documentazione societaria facilmente accessibile «difficilmente compatibile con un occulto accordo corruttivo», tale dunque da impedire «di poter ravvisare grave leggerezza o macroscopica trascuratezza» nel comportamento di Palazzesi.
