di giudici e avvocati: già oltre 7mila segnalazioni all’Associazione che li segue

Stordite, incapaci di reagire, risucchiate in un labirinto senza uscita. Così le vittime di malagiustizia raccontano di essersi sentite il giorno in cui si sono trovate coinvolte in una vicenda giudiziaria di cui erano totalmente all’oscuro. Chi ha dovuto affrontare un giudice fallimentare senza sapere perché, chi è stato portato in carcere per reati mai commessi, chi s’è trovato il decreto di sequestro preventivo sulla casa. Choc destinato a perpetuarsi nel tempo: riavere la fedina penale immacolata può richiedere decenni. Mentre la vittima invischiata in un’oscura vicenda giudiziaria viene trascinata in basso, i risarcimenti (spesso) restano un miraggio. Infine, può suonare come una beffa il fatto che, quand’anche una Corte avrà dettato l’agognata formula («assolto perché il fatto non sussiste»), non ci sarà tribunale disposto a portare sul banco degli imputati l’autore/autori dell’errore.

Tunnel senza uscita

Questa è la storia di Michele Tedesco, imprenditore di Bari assolto con formula piena nove anni dopo l’arresto per traffico internazionale di stupefacenti: nove anni che gli hanno distrutto la vita. Che dire, poi, della vicenda del piccolo Angelo, morto a 3 anni, investito da un pirata della strada: era il maggio 1984. Il risarcimento ai genitori è arrivato 33 anni dopo. E ancora Luca, bollato come delinquente abituale per uno scambio di persona: gli fu vietato di far ritorno nella frazione di Frosinone dove lavorava. Fu riabilitato dopo un’istanza al Ministero dell’Interno. La direzione centrale della Polizia Criminale cancellò i dati erronei. Ma lui ne fu informato solo due anni dopo,

Chi entra in questa spirale – spiega Mario Caizzone, che ha fondato nel 2012 l’Associazione italiana vittime di malagiustizia (Aivm, www.aivm.it)- viene triturato dal sistema». Ne è testimone diretto. Nel ‘92, nel clima rovente di Mani Pulite, fu arrestato per colpe non sue: «Sono trascorsi 22 anni per poter riavere la fedina penale immacolata». Per dieci non ha potuto svolgere l’attività di commercialista: «Mi ha salvato la mia famiglia. Ho sempre detto che se ne uscivo vivo – aggiunge – avrei fatto qualcosa per gli altri. Ero benestante, sono finito sul lastrico». Le vittime, dice, sono i «nuovi poveri». Come loro, «all’epoca fui sopraffatto dal panico, incapace di reagire». Nell’ufficio milanese che s’affaccia sulla Stazione Centrale, in piazza Luigi di Savoia 22, ogni giorno s’alternano 4/5 volontari: Valentina, Carlo, Nicola e Tea, che ricorda il caso di un’anziana «alla quale l’amministratore di sostegno sottrasse 40 mila euro». Molti sono laureandi in giurisprudenza o esperti di marketing e comunicazione. Alle spalle hanno un pool di consulenti. Il supporto alle «vittime» di malagiustizia è totalmente gratuito. Il telefono squilla con insistenza. È una donna: «Non so cosa devo fare», dice. Da due mesi scrive all’avvocato di fiducia per sapere com’è finita la transazione con l’ex socio. L’udienza in tribunale è imminente. «Chieda al giudice un rinvio, intanto prendiamo in mano il caso», risponde Caizzone, che precisa: «Non rappresentiamo in giudizio queste persone ma le aiutiamo a sbrogliare la matassa, le facciamo uscire dall’angolo».

Segnalazioni

In sei anni Aivm ha raccolto la segnalazioni di 7 mila persone. Uomini, donne, giovanissimi e pensionati, oltre la metà nei guai con la giustizia penale, altri a causa di banali querelle familiari divenute per incanto tragedie apocalittiche. «Non di rado a monte di tutto c’è la negligenza di un avvocato – aggiunge Caizzone – che perde la causa, perché non fa le giuste contestazioni o non presenta il ricorso nei tempi corretti». L’associazione, su invito della Commissione Giustizia della Camera ha proposto la revisione della carcerazione preventiva: «Non ha senso, distrugge la persona». Ha poi chiesto «la creazione di un intergruppo parlamentare per ridiscutere il gratuito patrocinio a spese dello Stato». Attualmente, per come è strutturato, «non dà garanzia. Chi controlla l’operato dell’avvocato d’ufficio?». Infine, Aivm sottolinea un aspetto cruciale: «I nomi degli imputati non devono essere divulgati fino all’udienza preliminare o al rinvio a giudizio, per dare la possibilità agli imputati stessi di difendersi». Il tema al centro è, innanzi tutto, la professionalità di avvocati e magistrati. «La giustizia arranca». Serve una sorta di «tribunale del malato, una Corte di giustizia – conclude Caizzone – che, oltre a dare supporto a chi si sente abbandonato, possa entrare nel merito del loro operato».

    Esattamente, occorre, come dice Caizzone, un tribunale delle persone coinvolte in giudizi sia penali che civili con sede all’interno dei tribunali.

    bisognerebbe anche fare le perizie piscologiche e psichiatriche ai Giudici di tutti i tribunali per capire se sono persone equilibrate e adatte a fare i giudici.
