Il reato di stalking è entrato a far parte dell’ordinamento penale italiano con la legge 38/2009 che ha introdotto il reato di “atti persecutori” all’art. 612 bis c.p.
In particolare, la norma punisce chiunque “con condotte reiterate, minaccia o molesta taluno in modo da cagionare un perdurante e grave stato di ansia o di paura ovvero da ingenerare un fondato timore per l’incolumità propria o di un prossimo congiunto o di persona al medesimo legata da relazione affettiva ovvero da costringere lo stesso ad alterare le proprie abitudini di vita“.
Lo stalking consiste in un insieme di condotte persecutorie ripetute nel tempo (come telefonate moleste, pedinamenti, minacce) che provocano un danno alla vittima incidendo sulle sue abitudini di vita oppure generando un grave stato di ansia o di paura o, ancora, ingenerando il timore per la propria incolumità o per quella di una persona cara.
Il bene giuridico protetto dalla norma è la libertà morale, cioè la facoltà della persona di autodeterminarsi. Ulteriori beni giuridici protetti sono l’incolumità fisica, la salute e, secondo alcune opinioni, la tranquillità psichica e la riservatezza dell’individuo.
Per quanto riguarda il contenuto delle condotte che integrano il reato di atti persecutori, rilevano sicuramente comportamenti che richiedono la presenza fisica dello stalker, ma la giurisprudenza ha ritenuto idonei anche le ripetute telefonate, l’invio di buste, sms, e-mail e messaggi tramite internet, nonché la pubblicazione di post o video a contenuto ingiurioso, sessuale o minaccioso sui social network; oltre, altresì, al danneggiamento dell’auto della vittima, alle aggressioni verbali alla presenza di testimoni e alle iniziative gravemente diffamatorie presso i datori di lavoro della vittima, per indurre questi ultimi a licenziarla, nonché, ancora, ad apprezzamenti, invii di baci e sguardi insistenti e minacciosi.
Si tratta comunque di condotte che devono essere necessariamente reiterate nel tempo.
Alla reiterazione deve aggiungersi, come requisito, il fatto che le condotte devono cagionare uno dei tre eventi previsti alternativamente dalla norma: l’alterazione delle abitudini di vita, un perdurante e grave stato di ansia o di paura, ovvero, un fondato timore per l’incolumità propria, di un prossimo congiunto o di una persona alla quale il soggetto è legato da relazione affettiva.
Ai fini della prova, l’effetto destabilizzante deve risultare in qualche modo oggettivamente rilevabile e non rimanere confinato nella percezione soggettiva della vittima del reato.
Con riferimento agli aspetti procedurali, il delitto di regola è punito a querela della persona offesa.
Il termine per proporre querela è di sei mesi e inizia a decorrere dalla consumazione del reato, che coincide con l’alterazione delle proprie abitudini di vita o in un perdurante stato di ansia o di paura, ovvero con il fondato timore per l’incolumità propria o di un prossimo congiunto.
