Daniele Barillà fu condannato a 15 anni di reclusione, accusato di essere un personaggio di spicco della malavita milanese. Nel 2000, dopo 7 anni e mezzo di carcere, è stato assolto.
L’errore giudiziario di cui è stato protagonista fu talmente clamoroso che gli furono dedicati il libro “L’uomo Sbagliato” e l’omonima fiction di Rai1.
L’Errore Giudiziario
Daniele Barillà fu erroneamente accusato di essere un malavitoso milanese, implicato in un grosso traffico internazionale di sostanze stupefacenti.
L’errore nasce nel 1992 durante un pedinamento del Ros, che seguiva una Punto con il carico di droga e una Tipo amaranto. A un certo punto la Tipo esce a uno svincolo e contemporaneamente entra in scena quella di Barillà che inconsapevolmente si mette dietro all’auto dei trafficanti.
Dato che gli investigatori non avevano annotato la targa della Tipo amaranto giusta, Daniele Barillà viene arrestato e sulla base delle accuse viene condannato a 15 anni in carcere.
L’Assoluzione Di Daniele Barillà
Il caso è stato riaperto nel 1997, insieme con altri processi, in seguito all’arresto del tenente colonnello Michele Riccio, responsabile dei ROS in Liguria e capo della DIA genovese, dato che la sua squadra aveva eseguito l’arresto di Barillà.
Riccio fu accusato di aver utilizzato metodi illegali per avere la fiducia dei “confidenti”, tra cui l’uso di partite di droga “scomparse” come mezzo di scambio.
Il caso di Barillà viene quindi rivisto e, dopo essere stato scarcerato il 12 luglio 1999, viene assolto il 17 luglio 2000 per non aver commesso il fatto.
Il risarcimento gli fu inizialmente negato, ma nel 2007 fu stabilito un maxi-risarcimento danni per ingiusta detenzione, grazie al quale riscosse quasi quattro milioni di euro.
Questa vicenda è stata poi ripercorsa dal libro “L’uomo Sbagliato: Il Caso Barilla” dal giornalista Stefano Zurlo. Inoltre, nel 2005 Rai1 ha realizzato una fiction di due puntate, romanzata ma ispirata a questo caso.
