Dai dati di un sondaggio emerge che solo il 39% degli italiani si fida dei magistrati.

Crollo della fiducia nella magistratura: 11 anni fa il dato era del 68%, oggi è del 39%. La diffidenza più alta tra chi vota Fratelli d’Italia. In cima alle critiche la durata dei processi.

Da un paio di settimane i riflettori sono nuovamente puntati sulla magistratura e le sue divisioni interne a seguito della vicenda sui verbali riguardanti l’avvocato Piero Amara che coinvolge alcuni magistrati della procura di Milano ed esponenti del Csm in conflitto tra loro sulla scelta di procedere o meno in un filone d’indagine su una presunta loggia massonica nella quale sarebbero coinvolti magistrati e uomini delle istituzioni. Si tratta di una vicenda complessa che, nonostante il grande rilievo mediatico, è stata seguita con attenzione da meno di un italiano su dieci, a cui si aggiunge il 27% che ha letto o ascoltato qualche notizia e il 22% che dichiara di averne sentito vagamente parlare, mentre il 42% ignora completamente la questione.

Non diversamente il precedente caso che ha riguardato Luca Palamara, l’ex presidente dell’Associazione nazionale magistrati ed ex membro del Csm, espulso dalla magistratura dopo le accuse di aver condizionato le nomine delle procure e che in un libro-intervista ha poi parlato diffusamente dei vertici della magistratura come di un «sistema degenerato». Questa vicenda, infatti, è stata seguita con attenzione solo dal 14% degli italiani mentre il 32% la ignora e il 54% ne ha solo sentito parlare. La conoscenza delle due vicende, come era lecito attendersi è più accentuata tra i laureati e i ceti dirigenti, presso i quali tuttavia non supera il 20%.
Dunque, molto rumore per nulla? Non sembrerebbe, a giudicare dai giudizi dei cittadini sulle vicende in questione e sulla fiducia nella magistratura.

Pur senza conoscere in larga misura i dettagli, il 45% ritiene che i due casi mettano in luce l’esistenza di comportamenti molto gravi (illeciti o corruzione) tra i magistrati, mentre il 20% è del parere che evidenzino l’elevata conflittualità esistente tra i vertici della magistratura e il 35% non ha un’opinione in proposito.
Tra i commenti emersi in queste settimane a proposito di queste vicende, alcuni ritengono che siano state sollevate ad arte da una parte del mondo giornalistico e politico che punta a delegittimare il più possibile il sistema giudiziario per sottrargli l’autonomia ed assoggettarlo alla politica o ai cosiddetti «poteri forti». Solo un italiano su cinque (19%) condivide questa tesi, poco più di uno su tre (36%) non crede al complotto e la maggioranza relativa (45%) non si esprime.

Quanto alla fiducia nella magistratura, oggi quasi un italiano su due (49%) dichiara di non averne, contro il 39% che si esprime positivamente e il 12% che sospende il giudizio. Decisamente meno fiduciosi sono gli elettori del centrodestra: la sfiducia viene espressa dal 71% degli elettori di FdI, dal 64% dei leghisti (un tempo più positivi, ma oggi più critici presumibilmente per le vicende che vedono coinvolto Salvini) e dal 53% degli elettori di FI. Da notare che anche tra i pentastellati, che sono spesso ritenuti giustizialisti, il 43% dichiara di non avere fiducia nella magistratura.

L’aspetto che più colpisce è il vero e proprio crollo di credito registrato in 11 anni, passando dal 68% di fiducia nel maggio 2010 al 39% odierno. Senza nulla togliere alle vicende Amara e Palamara, il motivo principale è però da attribuire al clima politico degli anni passati, contraddistinti dai rapporti conflittuali di Berlusconi con la magistratura e da una radicale contrapposizione nel Paese tra berlusconiani e antiberlusconiani che induceva questi ultimi a parteggiare per i giudici spesso indipendentemente dal merito delle questioni. Il tramonto politico di Berlusconi ha indotto molti cittadini a valutare con sguardo diverso il sistema giudiziario e l’operato dei magistrati. Non a caso oggi la maggioranza attribuisce il calo di fiducia ai tempi lunghi della giustizia (24%), alla presenza di magistrati politicizzati (18%) o corrotti (17%), oppure a sentenze discutibili (16%), mentre solo il 10% ritiene che ci sia una campagna denigratoria nei confronti dei magistrati. I problemi negati allora a causa dell’appartenenza politica, oggi vengono riconosciuti da molti. Basti pensare che pur permanendo un atteggiamento di maggiore severità da parte degli elettori del centrodestra, la quota degli elettori del centrosinistra e del M5s che non lesina critiche è piuttosto rilevante.

Negli ultimi anni ci eravamo abituati al discredito e alle generalizzazioni dei cittadini nei confronti della politica, oggi a farne le spese è la giustizia. Non è un bel segnale.
