Magliocca a Quarta Repubblica Ripercorre il Calvario Giudiziario: Nove Mesi in Carcere da Innocente.

Il presidente della Provincia di Caserta e sindaco di Pignataro Maggiore ospite da Porro: “Errore della magistratura e macchinazione politica“.

Giorgio Magliocca ha ripercorso il suo calvario giudiziario ospite da ‘Quarta Repubblica’, il programma di ‘Rete 4’ condotto da Nicola Porro.

Il presidente della Provincia di Caserta e sindaco di Pignataro Maggiore ha ripercorso quei drammatici momenti vissuti dall’11 marzo 2011, quando fu arrestato con l’accusa di concorso esterno per associazione mafiosa.

“Alle 5 di mattina suonarono a casa, scesi giù e trovai la polizia. Di lì a qualche ora mi ritrovai in cella; al carcere di Santa Maria Capua Vetere per i primi 20 giorni, poi dopo sono stato trasferito a Bellizzi Irpino in provincia di Avellino. Ho fatto 9 mesi in carcere e due ai domiciliari, da innocente”.

L’arresto per Magliocca “è stato un fulmine a ciel sereno perchè mai avrei potuto pensare di essere indagato. 

Non c’era il benchè minimo di straccio di prova, ma solo le propalazioni di un pentito che mi accusava di aver incontrato, alla vigilia delle elezioni comunali del 2006 a Pignataro Maggiore, il boss locale al quale in cambio di voti avrei consentito di continuare a gestire i beni che erano stati confiscati alla famiglia cammorristica”.

“Il problema è che l’incontro sarebbe avvenuto alla vigilia del maggio 2006 – ha spiegato Magliocca – In realtà dopo 9 mesi si scopre che il boss dal luglio del 2014 al luglio del 2007 era al 41bis, quindi fisicamente non avrei mai potuto incontrarlo.

Noi abbiamo trovato il documento che testimoniava che il boss era in carcere nel fascicolo del pubblico ministero. Il pm e il gip scrivono che forse il pentito ha confuso l’esponente del clan ed io con questo forse mi sono fatto altri 4 mesi di carcere”.

Magliocca alla fine è stato assolto perchè il fatto non sussiste. “E’ stato un momento difficile – ha raccontato – Ho sofferto tantissimo, non solo per la mancanza di libertà personale, ma soprattutto perchè sono stato lontano dalla mia famiglia.

Io avevo un rapporto morboso con il mio primo bambino, il secondo l’ho visto fare i primi passi dal carcere, visto che sono stato arrestato quando lui aveva 6 mesi.

Poi sono stato assolto perchè il fatto non sussiste e sono stato risarcito con 90mila euro”. Per Magliocca si è trattato di “una macchinazione politica” oltre che di un “errore giudiziario”.

“Il poliziotto che ha portato avanti l’indagine era un mio concittadino che faceva politica, tanto è vero che si era candidato qualche anno prima nello schieramento politico contro il mio – ha detto Magliocca – Lui ha valorizzato delle piccole mancanze sulla gestione dei beni confiscati omettendo invece di portare quei documenti che potevano convincere il pubblico ministero che non c’era mai stato l’accordo politico-mafioso”. 

Alla domanda di Porro sul perché dopo tutte queste peripezie ha deciso di ritornare a fare politica, Magliocca ha risposto:

“Perché viviamo in un sistema in cui, anche se vieni assolto, la gente pensa. Io avevo bisogno di capire se i miei concittadini avevano creduto alla mia totale estraneità ai fatti contestati. Avevo questo bisogno perché non ho mai tradito i miei concittadini. Mi sono ricandidato e la risposta di Pignataro è stata un vero atto di affetto”.
