Il Patrocinio Infedele: Le Sanzioni Previste Dalla Legge | aivm.it

Reato di patrocinio infedele per tutelare il regolare funzionamento dell’attività giudiziaria.

Il reato di patrocinio infedele è previsto dall’art. 380 c.p. il quale afferma che “il patrocinatore o il consulente tecnico, che, rendendosi infedele ai suoi doveri professionali, arreca nocumento agli interessi della parte da lui difesa, assistita o rappresentata dinanzi all’Autorità giudiziaria o alla Corte penale internazionale, è punito con la reclusione da uno a tre anni e con la multa non inferiore a cinquecentosedici euro”. 

Si tratta di una norma che vuole, da un lato, dare rilievo all’interesse particolare del cliente, dall’altro tutelare l’interesse pubblico al regolare funzionamento dell’attività giudiziaria, allo scopo di evitare che questi interessi possano essere lesi da comportamenti dei patrocinatori contrari ai doveri professionali di lealtà, fedeltà e correttezza.

Chi è il “patrocinatore”? Questa nozione ricomprende tutti coloro abilitati a difendere, rappresentare o assistere davanti all’autorità giudiziaria: si tratta di avvocati, praticanti con patrocinio, avvocati dello Stato, ufficiali difensori dinanzi ai tribunali militari.

Tra il patrocinatore e la parte deve sussistere un rapporto di assistenza, rappresentanza e difesa assunto tramite la nomina del patrocinatore per lo svolgimento di un’attività.

Perché si possa parlare di patrocinio infedele è necessario dimostrare che l’inadempimento degli obblighi professionali da parte del patrocinatore abbia portato un danno concreto al cliente. Di conseguenza, la parte non solo dovrà provare il comportamento infedele, ma dovrà anche dimostrare di aver subito un danno economico in seguito a tale comportamento.

Il cliente leso dall’ eventuale patrocinio infedele del proprio avvocato può denunciarlo alle autorità, come i Carabinieri, la Polizia, o depositare la denuncia presso la Procura della Repubblica. Si tratta di un reato procedibile anche d’ufficio e non necessita, quindi, della querela della parte.

La pena prevista dalla norma è aumentata se il colpevole ha commesso il fatto, colludendo con la parte avversaria oppure se il fatto è stato commesso a danno di un imputato.
